The Commission has the power to open negotiations with the Republic of Belarus on behalf of the European Union for an agreement on customs cooperation and mutual assistance. In June 1967, the Customs Cooperation Council (CCC), which changed its name to the World Customs Organization (WHO), defined the content of the “customs mutual assistance agreement model”; and most of the countries participating in the WCO are adopting this model as a project for the signing of a CMAA. The ROC has signed agreements with other countries on the basis of the WCO model, while negotiating the corresponding versions based on the status of the counterparty. An international agreement is the appropriate and necessary instrument to create a legal basis for the implementation of customs cooperation and mutual assistance with a third country, and in light of our objective of customs cooperation with Belarus, as it is the only country remaining on the EU`s eastern border that has not yet concluded a customs agreement. In accordance with this policy, customs cooperation and mutual assistance agreements allow the parties to put in place the necessary instruments for customs cooperation. In the interest of global trade and international assistance in the fight against customs fraud, the European Union has signed agreements on customs cooperation and mutual assistance (Korea, Canada, Hong Kong, the United States, India, China and Japan). In cases where the other party`s domestic law allows, the ccmaa agreements on “replacements” of the United Kingdom and the United Kingdom contain provisions that they can implement at the time of signing (often referred to as “final signature”). The parties would therefore be bound by these agreements when they were signed, although the provisions of the agreements would only take effect when the EU CCMAA agreements no longer applied to the United Kingdom. The application of the final signature in this case would allow the UK and its international partners, in the event of withdrawal from the EU without agreement, to transfer without interruption important customs agreements that currently exist because of the UK`s membership of the EU. The reason is that the agreement will not change, because it is a repetition of the agreement that the EU has currently concluded with the third country.
Although many international treaties must be explicitly ratified, it is also common in British and international practices for treaties to enter into force, to the extent that they are feasible, when they are signed.
